AOPA Announces Winners of the Otto and Lucille Becker Award and the Edwin and Kathryn Arbogast Award

WASHINGTON, D.C. – The American Orthotic & Prosthetic Association (AOPA) is pleased to announce the winners of the annual student poster awards.

Tyler Klenow as the recipient of the fifth annual Otto and Lucille Becker Award for his orthotic abstract, “A Functional Comparison of a Carbon Fiber AFO and Two Modular KAFO Conditions Using Outcome Measures in a Veteran Subject with Traumatic Brain Injury.” Tyler is a resident at James A. Haley Veteran’s Hospital, and graduated with a Master of Science in Orthotics and Prosthetics from Eastern Michigan University.

Lisa Abernathy, of Alabama State University, is the recipient of the fifth annual Edwin and Kathryn Arbogast Award for her prosthetic abstract, “Going Back In Time: A Content Analysis On The Media Portrayal Of Characters With Antiquated Prostheses.

The purpose of these awards is to honor two meritorious scientific papers submitted for presentation as a poster during the AOPA National Assembly and to encourage students and residents to display outstanding posters at the AOPA Annual Assembly.

The award recipients are invited to present their posters at the National Assembly, and are entitled to a $500 cash award, complimentary Assembly registration, up to 3 nights of hotel accommodations, airfare to the Assembly, and recognition during the awards ceremony. These awards are made possible by generous endowments from Becker Orthopedic and Willow Wood.

AOPA President, Charles H. Dankmeyer, Jr., CPO, remarked that “Tyler and Lisa represent the most promising of our future O&P professionals, and I am proud to say that our patients are in good hands.”

The honorees will be presented with the Awards at the 2015 AOPA National Assembly in San Antonio, TX, at the General Session and AOPA Annual Business Meeting on Friday, October 9 at 7:30 am.

Lower Limb LCD Policy Updates: What Has Happened after the Comment Period Closed and the August 26 Events

AOPA updated you on all the events on the LCD Policy Proposal – the comments we submitted and helped members and patients submit, the rally at HHS, the meetings we had with CMS, the open DME MAC meeting, the PR campaign, etc.

But what has happened since the closing of the comments on August 31st?

AOPA Meets with Office of Management & Budget

On September 16, AOPA Executive Director Tom Fise, along with our health care council, met with 7 representatives from the Office of Management & Budget (OMB) relating to the CMS Final Rule on Prior Authorization (you’ll recall the comment period closed about a year ago) which must be approved by OMB before it can be published.  During the meetings with CMS on August 26 relating to the LCD, AOPA secured a promise from CMS’ Chief Medical Officer to look closely at the Prior Authorization rule, as we contended that the combined effects of moving on both the LCD and Prior Authorization would have an exponential adverse impact on amputee patient care.

Getting OMB to intervene is a high bar to surmount, but AOPA had a positive exchange with them.  Overall our central message addressed three key points: (1) the Prior Authorization regulation was a CMS attempt to solve a problem which does not exist–no such extraordinary steps are needed to control Medicare expenditures for prosthetics because data shows that contrary to the OIG report, those expenditures have gone down in each of the past three years, and 2013 expenditures were less that expenditures in 2007; (2) the rule would prompt a decline in quality of care; and (3) it would delay patient receipt of care.  The discussion included AOPA’s assertion that the rule should NOT be enacted, but adding that if it was to be enacted, five criteria outlined in AOPA’s comments (including that it needs to be a guarantee of payment, that it needs to establish that there would be no medical necessity audits once Prior Authorization was secured, and that the prosthetist notes prohibition must be fixed).  We cited materials from the LCD press and amputee demonstration, including Senator Kerrey’s characterization that the LCD (and by analogy the Prior Authorization) was an instance of the government ‘creating a problem, not solving one.’

We will be providing some follow-up materials in areas of questions.  We will get no response (as they are not allowed to hint at the Final Policy), other than what we can observe in whether the rule moves forward into publication, and what provisions it contains.

United Health Care (UHC) Denies Medical Necessity of Vacuum Pumps: AOPA’s Strategy Moving Forward

In this new policy, which seems to be a result of the LCD Proposal, United Health Care deems vacuum pumps for residual limb volume management “…unproven and not medically necessary” as of October 1, 2015. Read the policy here.

AOPA is pursuing a two part strategy: (a) AOPA partnered with a congressional representative in UHC’s state, who contacted UHC requesting that they set up a high level meeting with AOPA reps; and (b) AOPA is joining in a letter of objection to the policy from the O&P Alliance, together with the Amputee Coalition, due for release this week, challenging the assertion that there is no scientific evidence to support this treatment, and seeking a meeting with UHC’s Medical Director.  We believe the results can be additive and symbiotic, not divisive, in bringing attention to the problem from multiple directions.

We promise to continue to keep you posted on the UHC issues, but we have also received an early indication about another mischievous outgrowth of the commercial sector jumping on the draft LCD as an opportunity for cutbacks–this time from one of the state BCBS plans.  We are waiting to see documentation, but if this proves correct, we will again communicate with the insurer AND communicate to CMS (as we did when the UHC policy first arose) underscoring yet again the need for a quick decision to rescind the draft LCD.

Wall Street Journal Article Published

After the initial media buzz of more than 400 press articles on the HHS rally and LCD Proposal, the media is still picking up on the issue in a big way: On September 20, The Wall Street Journal published an article on the issue.

Senators Dan Coats and Amy Klobuchar

Senators Coats (R-IN) and Klobuchar (D-MN), co-chairs of the Senate Medical Technology Caucus communicated with CMS Acting Administrator Andy Slavitt, urging CMS to immediately reconsider the policy proposal. Other legislators have weighed in with letters to HHS Secretary Sylvia Burwell and to  CMS Administrator Slavitt; read those letters here.

 

AOPA Announces Legislative Advocacy Award Honorees: Rick Riley; Teri Kuffel, Esq.; and Charles Kuffel, MSM, CPO, FAAOP

WASHINGTON, D.C. – The American Orthotic & Prosthetic Association (AOPA) will honor 3 recipients of the Ralph R. “Ronney” Snell Legislative Advocacy Award: Rick Riley; Teri Kuffel, Esq.; and Charles Kuffel, MSM, CPO, FAAOP. This award is presented to individuals in the field who have made valuable contributions toward advancing the legislative and regulatory goals of the O&P community by motivating members of Congress, state legislators and other decision makers to make sure the needs of patients and providers in our field are accommodated.

AOPA President, Charles H. Dankmeyer, Jr., CPO, praised the 2015 honorees stating “Rick, Charles and Teri are O&P industry champions who consistently and unselfishly invest their personal time to inform and educate legislators, regulators, and other professionals, with considerable impact. Their voluntary efforts reap benefits for all O&P businesses. AOPA salutes their advocacy.”

Rick Riley is the CEO at Townsend Design, where he started in 1995 as Vice President of Marketing. Rick has consistently attended AOPA’s annual Policy Forum, of which Townsend Design is a long time sponsor, to educate senators and congressional representatives, and has met with current majority leader for the House of Representatives, Kevin McCarthy. Rick encourages practitioners and suppliers to participate in the Policy Forum and other advocacy activities.

Charles Kuffel is the President and Clinical Director, and Teri is the Vice President at Arise Orthotics & Prosthetics, Inc. Both have been active in the Minnesota Society of Orthotists, Prosthetists and Pedorthists and both teach for the Master’s program in Prosthetics & Orthotics (MPO) at Concordia University in St. Paul, MN, in addition to their continued involvement with patient help organizations (humanitarian organizations) such as Minnesota’s Wiggle Your Toes. Charles and Teri have attended the AOPA Policy Forum for the past six years and each year have sponsored an amputee to join them. Both have worked with state legislators on behalf of MSOPP on licensure and insurance fairness issues. Teri serves on the MSOPP Board as well as being an AOPA state representative. Charlie has been president of the Northern Plains Chapter of AAOP and currently serves as vice chair of the National Commission on Orthotic and Prosthetic Education.

The honorees will be presented with the Legislative Advocacy Awards at the 2015 AOPA National Assembly in San Antonio, TX, at the General Session and AOPA Annual Business Meeting on Friday, October 9 at 7:30 am.

Update on AOPA’s Amputee Rally and CMS Meeting on LCD Policy

We started with a Tuesday press advisory which included AC and AOPA—Senator Bob Kerrey, Charles Dankmeyer, Adrianne Haslet, Drs. Paul Pasquina and Stephen Fisher, and Amputee Coalition President Dan Berschinski.  It began the tide of press interest which carried over to the August 26th events.  The DME MAC hearing attracted roughly 200 amputees, to hear 81 witnesses speak for 3 minutes each—roughly 50 addressing prosthetics and ALL opposing the DME MAC proposal.  AOPA President Charles Dankmeyer, CPO, Tom Watson, CP, Boston Bombing Amputee Adrianne Haslet and Executive Director Tom Fise each made presentations for AOPA. Spirits were high as the DME MAC Medical Directors listened without comment or note-taking to 5 solid hours of presenters.

The scene shifted to the Amputee Patient Rally at the HHS Headquarters.  Approximately 150 amputees attended, carrying signs, marching, chanting, and sharing stories (see photos below).  Last week, AOPA Executive Director Tom Fise had written to HHS Secretary Burwell, informing her of the planned rally, and offering to meet with her.  It came as a surprise when late Tuesday night, NAAOP Counsel Peter Thomas and Tom Fise received a reply offering a 4 pm meeting to 8 individuals with CMS Administrator Slavitt, the Senior Counsel to the HHS Secretary, Kevin Thurm, Deputy CMS Administrator Sean Cavanaugh (AOPA had met with Mr. Cavanaugh previously, on August 11) CMS Chief Medical Officer Patrick Conway, MD, And HHS’ Sharon Lewis along with other senior officials.

The O&P community was represented by 5 amputees among the group of 8 which consisted of: AOPA President Charles Dankmeyer, CPO; Tom Watson, CP; Adrianne Haslet, NAAOP President Dave McGill, Jack Richmond and Sue Stout from the Amputee Coalition, NAAOP Counsel Peter Thomas and AOPA’s Tom Fise. The group had a good, and hopefully productive meeting with CMS/HHS folks. The official CMS press release can be seen (below).  From AOPA’s perspective, CMS officials underscored that cost and financial concerns are not an appropriate basis for writing or changing an LCD, and that such decisions must have a strong evidence basis, and that assuring high quality of patient care for Medicare beneficiaries is a paramount concern.  Some strong attention focused on the letter from researchers (Jim Campbell, PhD, CO; working with Wendy Beattie, CPO; Gary Berke, MS, CP; Jason Highsmith, PhD, DPT, CP) and others had prepared and presented at the DME MAC session a powerful statement which was shared for the CMS/HHS officials, and the asserted absence of evidence-based rationale.  The CMS officials indicated that there will be follow-up conversations with the DME MACs, and if those discussions lead to strong emphasis on evidence and high quality patient care, I think it would point to a very different kind of LCD, one that may prompt some of the concerns expressed in various forms yesterday to be allayed.

Readout of Senior CMS and HHS Officials’ Meeting with Amputee Advocates
Today, senior officials from CMS and HHS met with individuals and representatives of groups concerned with a recent policy proposal issued by regional Medicare payment contractors regarding coverage of lower-limb prosthetics. CMS and HHS officials expressed the critical importance of Medicare beneficiaries’ access to appropriate and medically necessary lower-limb prosthetics, and appreciated hearing personal stories and comments on the proposal from the group.

As the proposal is still open for public comment, CMS and HHS officials stressed that stakeholders’ input was vital to the process as the Medicare regional payment contractors finalize a new policy. CMS officials said they would work with the regional contractors’ medical directors so that any final policy is supported by clinical evidence and does not limit necessary services for Medicare beneficiaries.

WASHINGTON, D.C – August 25, 2015 – A double amputee who has worn advanced prosthetic devices for decades no longer would be eligible for new prostheses because he never achieved a perfect “natural gait.” A 68-year-old minister of a church, who had her left leg amputated above the knee as a result of diabetes, would be denied an advanced prosthetic limb because Medicare once paid for a set of crutches that she used when she got up to use the bathroom during the night.  A 65-year old Viet Nam War veteran, who suffered an injury from an explosion at Khe Sahn in 1972 and had his right leg amputated above the knee, switched from Veterans Administration (VA) health care to Medicare, and would not get his ninth prosthesis because he occasionally used a wheelchair during business travel. A retired mechanic, who suffered a sepsis infection that resulted in the amputation of his  right leg below the knee, would be denied a prosthetic device by Medicare because he takes a common medication for the treatment of hypertension. 

These real-life stories are drawn from the ranks of the estimated two million American amputees who would see significantly reduced access to care under a rule proposal now pending before Medicare, according to a warning issued today by the Amputee Coalition and the American Orthotic & Prosthetic Association (AOPA). While all of the individuals cited above qualify for reimbursement of care that is readily available today, the draft Medicare rule would “turn back the clock” to a time when the type of prosthetics available were less functional and provided less mobility. The proposed changes in coverage for services provided not only would have a devastating impact on Medicare amputee beneficiaries, but on all of the two million amputees in the U.S., since commercial health insurance payers and the VA tend to follow the lead of Medicare on coverage matters.

For weeks now, a groundswell of opposition has been growing to the proposal now before Medicare.  More than 105,000 Americans have signed a “We the People” White House petition asking Medicare to rescind the proposal restricting access to prosthetic limbs.  The Amputee Coalition also has organized a social media campaign using the #notaluxury hashtag aimed at helping amputees to learn about the proposal and provide comments to Medicare.

The debate over the draft Medicare rule will reach a boiling point tomorrow.  A Wednesday public hearing will be held at 8 a.m. in Linthicum, Maryland, where amputees and other stakeholders will present their concerns about the new proposed Medicare policy. Also on Wednesday: An amputee rally organized by AOPA will take place at 2 p.m. outside of the offices of the Department of Health and Human Services (HHS) on the north sidewalk in front of 200 Independence Avenue SW.  Hundreds of amputees and other concerned individuals from across the U.S. are expected to participate.

Hon. Bob Kerrey, former U.S. Senator from Nebraska, said: “Today, Medicare officials have before them a draft rule that would increase the suffering of hundreds of thousands of men and women who are working hard to make their way in the world as amputees.  It is not an exaggeration to say that research into advanced prosthetics will not only cease but the standard of care will regress back to the good old days in 1969 when I was first fit with a wooden leg.”

Adrianne Haslet, Boston Marathon survivor and professional ballroom dancer, said: My life changed completely in 3 seconds at the finish line of the Boston Marathon, and I am very fortunate to have had access to the advanced prosthetics that have allowed me to return to dancing and a largely normal life.  Medicare beneficiaries deserve the same chance those high-quality prosthetics have given me.

Dan Berschinski, chairman of the board of directors, Amputee Coalition, said: “This proposal represents a significant setback for amputees in the United States. It would mean that hundreds of thousands of Americans who now are active parents, grandparents, employees, and community volunteers would not be able to receive the most appropriate device for their needs at the most appropriate time.”

Charlie Dankmeyer, president, American Orthotic & Prosthetic Association, said:   “It is very difficult to imagine any other aspect of American healthcare where millions of people would be denied available and appropriate treatment and devices that can speed their return to the fullest and most active possible life. Even worse, there is no medical or scientific justification for these unreasonable and inappropriate hurdles that would amount to a return to a 1970s standard of care.”

Paul F. Pasquina, M.D. (Colonel, U.S. Army retired), said:  Throughout my medical career I have had the opportunity to treat many patients and advise them and their families during their physical and psychological recovery after amputation.  I have seen the tremendous improvements in prosthetics in recent years, and how they have greatly improved the lives of individuals with limb loss – enhancing rehabilitation outcomes and independence.  It is for those reasons that organizations such as the Department of Defense, Department of Veterans Affairs, and the National Institutes of Health have invested so heavily in supporting the advancement of this technology – not only to enhance the care of our nation’s heroes, but to elevate the care of all Americans with disabilities.  It is therefore, disheartening for me to see Medicare proposing steps that would likely place barriers between patients and these very beneficial advanced prosthetics.”

Jack Richmond, an amputee from Cleveland, TN., and board member of the Amputee Coalition, said:  The Amputee Coalition has always maintained that arms and legs are not a luxury and shouldn’t be treated as such. Everyone needs to know that amputees matter and that any changes to current amputee care must ensure patients are able to receive the most appropriate prosthetic device for their needs when they need it.”

Among the key concerns about the proposed Medicare policy restricting care for amputees are the following:

  • If you are an amputee using – or who has used in the past — an assistive device such as a cane, crutch or walker, you will be limited to less functional prosthetic devices – even if you only use the assistive device briefly or for limited purposes, such as getting out of bed at night to go to the bathroom.
  • You could be provided a less functional prosthesis or denied a device altogether just because you may not be able to attain the “appearance of a natural gait.” However, as this first of two videos shows, it is not uncommon for individuals in the initial post-operative and rehab periods to have great difficulty. As this second video shows, the same individual may improve far beyond how he or she is assessed initially.  However, no such improvement would be possible if a prosthetic device is denied by Medicare based on an unduly negative front-end assessment.  In other cases, patients who never achieve a truly “natural gait” can and do rely up prosthetics to live a full life.
  • If your medical record references certain health issues, including such common conditions as high blood pressure and asthma, Medicare could deny you access to the best available care. With no sound scientific basis, this arbitrary provision would unfairly and needlessly knock hundreds of thousands of amputees out of consideration for the most appropriate prosthetic device for their needs.
  • The Medicare proposal redefines the rehabilitation process for amputees and forces new amputees to undergo rehab using out-of-date technology that they will not even use once they receive their permanent prosthetic device. This means that the rehab for amputees will be of less value than if it was carried out with the most appropriate prosthetic device for their needs, as is common practice today.

Former Senator Bob Kerrey, Boston Marathon Survivor Join Amputee Coalition and AOPA in Urging Medicare to Rescind Draft Rule Imposing “Serious Setback” for Amputees.

WASHINGTON, D.CA double amputee who has worn advanced prosthetic devices for decades no longer would be eligible for new prostheses because he never achieved a perfect “natural gait.” A 68 year-old minister of a church, who had her left leg amputated above the knee as a result of diabetes, would be denied an advanced prosthetic limb because Medicare once paid for a set of crutches that she used when she got up to use the bathroom during the night. A 65 year old Viet Nam War veteran, who suffered an injury from an explosion at Khe Sahn in 1972 and had his right leg amputated above the knee, switched from Veterans Administration (VA) health care to Medicare, and would not get his ninth prosthesis because he occasionally used a wheelchair during business travel. A retired mechanic, who suffered a sepsis infection that resulted in the amputation of his right leg below the knee, would be denied a prosthetic device by Medicare because he takes a common medication for the treatment of hypertension.

These real-life stories are drawn from the ranks of the estimated two million American amputees who would see significantly reduced access to care under a rule proposal now pending before Medicare, according to a warning issued today by the Amputee Coalition and the American Orthotic & Prosthetic Association (AOPA). While all of the individuals cited above qualify for reimbursement of care that is readily available today, the draft Medicare rule would “turn back the clock” to a time when the type of prosthetics available were less functional and provided less mobility. The proposed changes in coverage for services provided not only would have a devastating impact on Medicare amputee beneficiaries, but on all of the two million amputees in the U.S., since commercial health insurance payers and the VA tend to follow the lead of Medicare on coverage matters.

Please recognize that advertising operates with the challenge of conveying a very complicated story in a very few words (our 30-second TV message was confined to no more 74 words available to tell our story), and without the alphabet soup of CMS, DME MAC and LCD which are common parlance to us but which just confuse the general public.  There is not a strong ‘call to action’ because our real audience in the Washington DC market is government officials—we want to use these messages as the background chatter to support the activities, especially the Wednesday events.  We are carrying the second flight of ads right after Congress returns.

“Return to 1970’s Standard of Care”: Proposed Cost-Cutting Move Would Severely Limit Availability of Appropriate and Medically Necessary Prosthetic Care for Amputees.

WASHINGTON, D.C. – August 19, 2015 — Proposed changes to Medicare’s reimbursement for lower limb prosthetic care would create unreasonable and clinically unjustified hurdles to amputees receiving care that is now routinely provided, according to a warning issued today by the Amputees Coalition and the American Orthotic and Prosthetic Association (AOPA). The proposed changes in amputee care not only would have a devastating impact on Medicare amputee beneficiaries, but on all of the two million amputees in the U.S., since commercial health insurance payers tend to follow the lead of Medicare on such matters.

According to the Amputee Coalition there are roughly two million persons in the U.S. living with limb loss, and there are approximately 185,000 new amputees each year. Medicare’s data for 2009 showed over two million prosthetic services with a total expenditure of $655 million including new prosthetic feet for 36,600 Medicare beneficiaries. The Medicare policy would extend on a de facto basis to an estimated 10 million prosthetic services per year when including all payer sources for two million amputees.

Amputee Coalition President Susan Stout said: “This proposal represents a significant setback for amputees in the United States. It would mean that hundreds of thousands of Americans who now are active parents, grandparents, employees, and community volunteers would not be able to receive the most appropriate device for their needs at the most appropriate time. The Amputee Coalition is working hard to ensure that amputees are able to reach their full potential and that two million Americans do not see their standard of care negatively impacted by this proposal. Amputees must be able to continue to receive the most appropriate device for their needs.”

AOPA President Charles Dankmeyer said: “It is very difficult to imagine any other aspect of American healthcare where multiple millions of people would not be able to receive appropriate treatment and devices that can speed their return to the fullest and most active possible life. Even worse, there is no medical or scientific justification for these unreasonable and inappropriate hurdles that would amount to a return to a 1970s standard of care. No one is asking for more here; this is simply a situation where an appeal is being made to avoid forcing millions of Americans to suffer with much less in terms of the care readily available to them today.”
