The Advance Beneficiary Notice of Noncoverage (ABN) form is subject to re-approval and renewal every three years, and the current version of the ABN was approved in 2023 and expired on January 31, 2026. The new ABN, form CMS-R-131, was approved by the Office of Management and Budget (OMB) and recently released.
There were minor changes made to simplify the form, but the content and the directions for use of the ABN have not changed. The use of the revised ABN will be mandatory for claims on or after May 12, 2026. To verify if you are using the most recent version of the ABN, on/after May 12, 2026, be sure to check the expiration date on the bottom left corner of the form; it should be March 31, 2029
